Acceptance of Terms

These Terms of Service ("Terms") govern your use of NotchLive, a macOS application developed and operated by TinyThings ("we", "us", "our", "the Company"). By downloading, installing, or using NotchLive, you agree to be bound by these Terms. If you do not agree, do not use the app.

Eligibility

You must be at least 13 years old to use NotchLive. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

License

NotchLive grants you a limited, non-exclusive, non-transferable, perpetual license to use the application. The Free tier is available indefinitely. Pro upgrades unlock additional features for the activation limit included with the license you purchased, including individual Pro and Team Pack license keys. Individual Pro license keys are for one purchaser and may not be shared. Team Pack keys may be shared only with authorized members, employees, contractors, or collaborators of the purchasing team or organization, within the purchased activation limit. You may not resell, sublicense, redistribute, reverse-engineer, or modify the application except where applicable law gives you rights that cannot be waived.

Free & Pro Tiers

NotchLive offers a Free tier with real-time captions, all AI models, system audio and microphone capture, keyboard shortcuts, and unlimited use - forever, with no trial period. Pro adds real-time translation, Voice Notes with AI cleanup, Saved Notes, session recording, session history, and transcript export. Individual Pro and Team Pack licenses are perpetual and valid for the activation count included with the purchased license.

Team Pack Licensing

Team Packs are shared-key licenses for internal use by the purchasing person, company, team, or organization. They are not reseller, distributor, marketplace, or managed-seat licenses. A Team Pack gives the purchaser one shared license key with a fixed number of Mac activations; it does not create individual accounts, named seats, SSO, admin controls, audit logs, or per-user revocation rights.

You may not split a Team Pack into individual licenses for resale. You may not sell, rent, broker, sublicense, list, transfer, or otherwise offer Team Pack activations or access keys to unrelated third parties. If a Team Pack key is resold, shared publicly, used outside the purchasing organization, or used to bypass the intended activation limits, we may disable, rotate, or refuse support for the key and may refuse refunds except where applicable law requires otherwise.

Payments and Polar

Purchases are processed by Polar, our merchant of record and authorized reseller. Your purchase may also be subject to Polar's Buyer Terms and Polar's Privacy Policy. Polar handles payment collection, taxes where applicable, invoices, receipts, and some buyer support flows.

Refund Policy

Refund requests must be submitted within 14 days of purchase to support@tinythings.app or through Polar support. Refunds may be limited or refused for abuse, fraud, or violations of these Terms, except where applicable law requires otherwise.

User Content

You retain ownership of all content generated by NotchLive (transcripts, session recordings, exported files). We do not claim any rights to your content. All user content is stored locally on your device.

Audio Processing

NotchLive captures and processes audio from your system and/or microphone solely for captions, transcription, translation, notes, and session recording features you choose to use. Processing occurs on your device. Temporary local processing files may be created during recording or finalization and deleted after processing. Audio is not transmitted to our servers.

License Verification and Updates

Pro features require license verification through Polar. The app may send your license key and a machine identifier to verify activation limits. The app may also download local AI model files and check for software updates through Sparkle. See the Privacy Policy for details.

Intellectual Property

NotchLive, its name, logo, and all associated intellectual property are owned by TinyThings. These Terms do not grant you any right to use our trademarks, branding, or other proprietary materials except as needed to use the application as intended.

Disclaimer

NotchLive is provided "as is" without warranties of any kind. Speech recognition accuracy depends on audio quality, language, and the selected AI model. We do not guarantee uninterrupted or error-free operation. Use the app at your own discretion.

Limitation of Liability

To the maximum extent permitted by law, NotchLive and its developers shall not be liable for any indirect, incidental, or consequential damages arising from the use of the application, including inaccurate transcriptions or data loss.

Termination

We may suspend or terminate your license if you violate these Terms. Where possible, we will provide notice and a reasonable opportunity to cure the violation. Termination does not entitle you to a refund except as required by applicable law.

Changes to Terms

We may update these terms from time to time. Continued use of NotchLive after changes constitutes acceptance of the revised terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

General

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. These Terms constitute the entire agreement between you and TinyThings regarding your use of NotchLive.
